Two humans shaking hands

Downward Terms and Conditions

These terms apply when you download or use Downward, an app made by Second Victor Ltd ("Second Victor", "I" or "me"). Second Victor is a one-person company run by me, Allan Davis. Please read them before using the app.

Downward is supplied through Apple's App Store, so Apple's Licensed Application End User Licence Agreement also applies. These terms sit alongside it. If the two ever disagree, Apple's agreement takes priority.

Using the app

You can use Downward on any Apple device you own or control, as allowed by the App Store's usage rules. Downward and everything that comes with it, including its code, design, built-in themes and name, belong to Second Victor. Please don't copy, modify, resell or redistribute the app, or try to extract its source code, except where the law allows you to.

Supporter Upgrade and Tip Jar

Downward is free to download. The optional Supporter Upgrade is a one-time In-App Purchase that unlocks extra themes, importing and exporting custom themes, and importing your own fonts.

The optional Tip Jar lets you leave a one-off tip as an In-App Purchase. Tips are a way to say thanks and don't unlock anything in the app.

Payment is handled by Apple through your Apple Account, and the price is shown before you buy. Refunds are also handled by Apple, and you can request one at reportaproblem.apple.com. The Supporter Upgrade is linked to your Apple Account, so you can restore it on your other devices.

I won't take away features you've paid for. If a change outside my control, such as a change Apple makes to iOS or iPadOS, means a paid feature has to change, I'll explain why on this site.

Your files

Downward opens and edits the files you choose, stored on your device or in iCloud Drive. Your files stay where they are and are never sent to me.

Please keep backups of anything important. Files in iCloud Drive are synced by Apple, and I can't control sync conflicts, iCloud outages, or files being moved, renamed or deleted by other apps. I'm not responsible for files lost for those reasons, but this doesn't affect your rights under "My responsibility to you" below.

Internet and data charges

Downward works offline with files stored on your device. Opening and syncing files in iCloud Drive needs an internet connection, and your mobile network provider may charge you for the data used, including roaming charges when you're abroad.

Keeping your device secure

Please keep your device and its passcode secure, and don't use Downward on a jailbroken device. Removing the operating system's protections makes your device less secure and may stop the app working properly.

Updates and availability

Downward currently runs on iPhone and iPad. I may update it to add features, fix problems or keep it working with new versions of iOS and iPadOS. Some updates may need a newer version of iOS or iPadOS, and older versions of the app may stop being supported.

If I ever decide to stop offering Downward, I'll give reasonable notice on this site where I can. Copies already on your device should keep working, but won't receive further updates.

My responsibility to you

If you live in the UK, you have legal rights for digital content that is faulty or not as described. Citizens Advice can tell you more about them. Nothing in these terms affects those rights.

I'm responsible for loss or damage you suffer that is a foreseeable result of me breaking these terms or not using reasonable care and skill. I'm not responsible for loss or damage that isn't foreseeable. If faulty content I've supplied damages your device or other digital content you own because I didn't use reasonable care and skill, I'll either repair the damage or compensate you.

Downward is supplied for personal use. If you use it for business, I'm not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Nothing in these terms limits my liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud.

Apple

These terms are between you and Second Victor, not Apple. Apple isn't responsible for Downward or its content and doesn't provide support for it, so please contact me with any questions or problems.

Changes to these terms

I may update these terms from time to time, for example when I add new features. The latest version will always be on this page with the date it was last updated. If I make a significant change, I'll also mention it on this site.

The law that applies

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring them there.
